What Issues Could
Court Future Justice Alito Affect?
By: Jason Cunningham (1/14/2006)
Some people are hoping that
future Supreme Court Justice Samuel Alito will help overturn Roe vs. Wade.
Do not count on it. However, Alito is going to have an important say over other
important issues.
In the area of affirmative action,
I see it on the decline, as a result of his future appointment. The issue has
been criticized for giving minorities preferential treatment over the majority.
While, most people clearly do not understand all of the circumstances and the
applications of it; many assume that college or university are taking seats from
Caucasians. Maybe, it is not well known that grades are not the only criterion
that the institution must consider when reviewing applications. Nevertheless, I
believe Alito will carefully craft his opinions to further restrict, if not
eliminate affirmative action as we know it. Yet the education gaps in schools do
not appear to be on the mend. If your parents have money and attended college or
own their own business, you have a better chance as a child. On the other hand,
if your parents lack the education skills and you attend an inferior school, you
could succeed! Unfortunately, this is not story that all will tell. My challenge
to Samuel Alito is quite simple: If affirmative action is not needed, then the
parents of those who strongly oppose it, should send their child to the worst,
most populated school in the state. You are saying everyone gets an equal
education and opportunity!
Also, Judge Alito will probably be
a strong advocate siding with the government in several key areas. I think where
the government has business interests in a property, the homeowner will become a
victim of imminent domain. The United States could continue to restrict certain
First Amendment Rights for the sake of protecting against terrorism. I cannot
see Alito standing in the way of an executive order involving National Security,
even if the majority of the American people disagree with his decision. In my
eyes, Samuel Alito will not change his ideology one bit, as a result of him
being confirmed in the future as a Supreme Court Justice.
Alito's future appoint will
affect the Court in two major areas. One, minority rights should be worried
about when Alito becomes the ninth member of the Supreme Court. The power of the
government and the executive will grow stronger with Alito behind the bench. He
is more concerned with government rights than those of the individual.
